National development management policies NDMP
National development management policies (NDMPs) are a a new category of planning policies that were introduced through the Levelling Up and Regeneration Act 2023. NDMPs will carry the same weight as local plans in decision-making on planning applications. NDMPs will drawn up by the Secretary of State for Levelling Up, Housing and Communities (DLUHC) with public consultation, in a case of a conflict between the two, NDMPs will override local plans. The intention is for NDMPs will make local plans faster to produce and easier to navigate because nationally important issues will be protected by NDMPs and safe guard against out dated local plans local which will be able to focus on locally important issues.
NDMPs should be subject to appropriate tests set out in legislation, initially they will be applicable nationally and consistent with wider Government policies and other NDMPs. For example policies surrounding net zero and other policies relating to economic, social and environmental objectives forming the basis of sustainable development. Importantly NDMPs are intended to be minimum national standards, which exceeded locally where evidence exists to justify this.
In response to NDMPs in the Levelling Up and Regeneration Act 2023 the Home Builders Federation said NDMPs could standardise policies that were already contained in most local plans., which said currently, a lack of consistency and made local plans difficult to navigate for developers.
The Local Government Association (LGA) and Royal Town Planning Institute (RTPI) said they supported NDMPs ‘in principle’, but expressed concern that, in case of a conflict between the two, NDMPs could override local plans. The LGA argued that this undermined “the idea of a local, plan-led system”.
